Germany: Fragile liberal politicians file over 1,300 defamation cases against citizens

Germany has seen a sharp rise in defamation cases against citizens accused of insulting public officials, igniting debates about free speech.

Over the past three years, more than 1,300 cases have been filed, largely under the current coalition government of the Social Democrats (SPD), Greens, and Free Democrats (FDP). Green Party leaders Robert Habeck and Annalena Baerbock have been prominent complainants.

One notable case involved Stefan Niehoff, a 64-year-old Bavarian pensioner. Police raided his home after he shared a meme calling Vice Chancellor Habeck an “imbecile.” Niehoff likened the raid to authoritarian practices, while prosecutors acknowledged the meme alone prompted the action. Habeck justified the crackdown, arguing such insults harm public discourse and advocating stricter social media regulations to enforce “rules of decency and democracy.”

Critics warn these measures stifle legitimate dissent and satire. Earlier this year, a Bavarian woman faced a €900 fine and a home search for sharing a meme mocking Chancellor Olaf Scholz and Baerbock, which authorities deemed criminal despite its satirical tone.

Section 188 of Germany’s Criminal Code, introduced during Angela Merkel’s tenure, allows politicians to pursue legal action over defamatory remarks deemed to obstruct official duties. Convictions can lead to fines or up to three years in prison. Opponents argue the law unfairly protects politicians while chilling criticism and satire.

Defamation investigations have soared, with Münster seeing cases jump from 17 in 2021 and 2022 combined to 137 in 2024. Halle reported an increase from 11 cases in 2022 to 81 so far this year.

As the government enforces stricter standards of “decency,” many worry free speech is being undermined in a democracy known for valuing open dialogue and criticism.
